GST Charges in Commercial Leases

Blog – GST Charges

The Office of the Queensland Small Business Commissioner (QSBC) has provided information to callers enquiring about the application of Goods and Services Tax (GST) on rent and outgoings. In one such case, the query came following a change in property ownership which saw GST begin to be charged in addition to the rent and outgoings. The company that bought the property was registered for GST, whereas the previous owner was an individual and wasn’t required to register for GST. This scenario is relevant for tenants who may encounter similar GST implications under a new property manager or property owner.

Australian Taxation Office Resources to Clarify Obligations

The Australian Taxation Office (ATO) provides resources that can help clarify when GST applies to commercial leasing:

Key points from the ATO include:

  • GST Registration: GST on rent and outgoings is generally required if the lessor is registered or required to be registered for GST.
  • Change of Ownership: If a new owner is registered for GST, this may have to be included in future rent and outgoings.
  • No GST Duplication: GST cannot be charged on top of a pre-existing GST amount.
  • Lease Agreements: Tenants should review their lease agreement to understand the GST terms and seek professional advice if necessary.

The ATO resource Goods and Services Tax Ruling GSTD 2000/10 includes several scenario-based examples to clarify when GST may or may not be applicable.

The QSBC publishes factsheets offering information on matters like Outgoings. The QSBC can point you to resources like those above, containing information that might help, but cannot provide you tax, financial or legal advice.
